Inleiding

In de jaren zestig van de vorige eeuw stond de Amerikaanse rechter Potter Stewart voor een lastig dilemma. Hij moest beslissen of de Franse film Les Amants (1958) wel of niet moest worden verboden omdat die pornografisch zou zijn. Stewart boog zich over de zaak en constateerde dat er geen heldere definitie van pornografie bestond. Hij besloot tot een praktische aanpak. Er bestaat weliswaar geen sluitende definitie zei Stewart, ’but I know it when I see it’, en oordeelde dat de film geen obsceniteiten bevatte die de grens van het toelaatbare overschreden.
